This is the current version of the Privacy Policy for Karina Mercier, updated on June 6, 2024.

I may change this Privacy Policy at any time without notice. These changes will be operational from the time they are posted on the site or when they are communicated to users by any means, depending on what happens first. The user should keep informed of the terms included here by checking periodically.

Scope and Application

This policy applies to the karinamercier.com website and any forms and components it may contain. However, please note that the website may include links to third party sites. This Policy ceases to apply when you leave our website.

The policy also applies to data collected by all other means of communication (emails, text messages, phone calls and in-person meetings).

Consent

I am committed to obtaining consent before collecting an individual’s personal information. Consent may be express or implied and may be provided directly by the individual or their authorized representative.

My preference is to obtain express consent, whether it be verbal, electronic, or in written form. However, implied consent may reasonably be inferred from an individual’s action or inaction.

For example, providing an email address to obtain an answer to a question is considered implied consent to the collection of information containing personal information. 

If I want to use personal information for a new purpose than the purpose for which it was collected, I will describe the intended use and seek consent again.

Karina Mercier may collect personal information in various forms, but will only do so by lawful means and only for necessary purposes that have been disclosed to you, as described in this Policy, or where permitted or required by law.  The personal information collected and its sensitivity may vary depending on the context in which the interactions between you and Karina Mercier take place.  I am committed to protecting all personal information collected.

The following information may be collected:

  • Name and contact information.
    First and last name, email address, mailing address, telephone number and other similar data used to communicate with you or process your orders.
  • Proof of identity.
     I may use your information for identification and authentication purposes.  For example, when you enter your account login and password to access one of our registration or login portals, your login information is used to authenticate your identity.
  • Demographics.
     Data about you such as your age, gender, country and language of communication. 
  • Location data, IP address and other statistical data provided when you use the website, including data from Google Analytics.
  • Registration data. For example, name and email when you fill out the form to receive the newsletter.

I use Square integrated service to securely process payments.  I do not have direct access to your credit card number and it will not be stored on my website or in any of my databases.

Purpose of the data collection

The data collected during the use of the website, or by other means of communication such as email, text or telephone call may be used for the following purposes:

  • To provide services, process orders and respond to requests. I will use the necessary data and information to process orders, answer questions, and fulfill our mission and contractual obligations.
  • To provide and improve services.  The data collected during interactions with my services, for example the contact form, may be used for the purpose of analyzing and improving the functioning of the latter.
  • To evaluate the performance of the website.  The data is collected in order to evaluate them and solve problems if necessary.
  • To protect the privacy of the users. The data collected allows me to verify the identity and protect the privacy of individuals who create an account on the site, communicate with me by phone, email or otherwise.
  • To meet legal obligations. Data is collected to meet obligations under international laws, regulations or treaties.

Cookies

When the user enters karinamercier.com, information may be stored on their computer in the form of a “cookie” or similar file. 

The user can accept, personalize or refuse the use of cookies via the banner for this purpose appearing on the site.   Karinamercier.com uses cookies only to collect data on site traffic and improve the user experience when using the site.

The user must know that in order to browse the site, it is not necessary to allow the installation of cookies sent by the site. This may only be required for certain services.

Cookies are information files that the site or the provider of certain services of the site transfers to the hard drive of the user’s computer via the browser program. The cookies themselves cannot personally identify the user (although they may contain the user’s IP address) but they allow the user to recognize the user’s browser and capture and store certain data (user’s operating system, domain name of the website from which the site was linked, among others). Karina Mercier reserves the right to contract the services of third parties to analyze and understand the users of the site, who cannot use the information collected for other purposes than to improve the services of Karina Mercier.

Confidentiality

The personal data collected by Karina Mercier will not be transferred, sold, exchanged, transmitted and/ or communicated to third parties without the consent of the user, except for legal obligation and/ or for the purpose of providing the services to the user.

Conservation

The collected data will be kept for as long as it is needed for the management of the services or for other purposes such as compliance with legal and tax obligations.

The data will be destroyed at the request of the user if they are no longer strictly necessary or relevant for the purposes detailed above.

Security

Karina Mercier is committed to adopt technical (including the use of https protocol and security plugins) and organizational measures to ensure security, integrity and confidentiality of the data in accordance with the Québec Personal Information Protection and Electronic Documents Act (Bill 25) and Canada’s Anti-Spam Legislation (CASL) in order to prevent their alteration, their loss, consultation or unauthorized treatment.

Rights

The customer or user of the website may, at any time, have access to his personal data.   He has the rights of rectification, cancellation, limitation of processing, portability, confidentiality and deletion concerning his personal data.   These rights can be exercised by the user himself by email at karina@karinamercier.com.   Karina Mercier may request the necessary data to validate the identification of the data owner.  

The deletion of certain data will not be carried out when it could cause damage to the rights or legitimate interests of third parties, or when there is a legal obligation to retain the data.
